The opinion of the court was delivered by Alvin R. Turner, appellant, hereinafter referred to as defendant, was duly charged by an information in the district court of Johnson county with the crime of murder in the first degree in shooting and killing John R. Keach. Upon a trial, the jury found the defendant guilty as charged and fixed the punishment at life imprisonment. From an order overruling his motion for a new trial, defendant has appealed and contends the court erred in: (1) overruling his motion for a change of venue; (2) overruling his motion to quash the information; (3) admitting specified evidence; (4) admitting into evidence written statements made by defendant which defendant maintains were involuntarily given; (5) admitting into evidence two photographs taken of the deceased at the place of the murder; and (6) failing to properly instruct the jury.
